By accessing and using AgentPulse ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

AgentPulse provides AI-powered video editing and content creation tools designed to help real estate agents and professionals create engaging marketing content. Our service includes video editing, template creation, and content optimization features.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Upload content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights
• Attempt to gain unauthorized access to the Service or its related systems or networks
• Use the Service for any commercial purpose without our express written consent

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of AgentPulse and its licensors. The Service is protected by copyright, trademark, and other laws.

6. Subscription and Payment

Some features of the Service may require a paid subscription. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8. Limitation of Liability

In no event shall AgentPulse, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

9. Disclaimer

The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, this Company excludes all representations, warranties, conditions and terms whether express or implied.

Governing Law

These Terms shall be interpreted and governed by the laws of Texas, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and AgentPulse regarding the use of the Service, superseding any prior agreements between you and AgentPulse relating to your use of the Service.
